These End User Terms ("Terms") are between Gergely Orbán, sole proprietor, Hungary ("Provider", "we") and the organization that installs the CFR Dashboard Forge app (the "App") via the Atlassian Marketplace ("Customer", "you"). By installing, enabling or using the App you accept these Terms; if you act for an organization, you confirm you may bind it.
The App is distributed under the Atlassian Marketplace Terms of Use. These Terms supplement, and do not replace, the relationship between you and Atlassian.
CFR Dashboard is a Forge app for Jira Cloud that calculates Change Failure Rate and Mean Time to Restore from revert commits in the Git repository connected to a project (GitHub, Bitbucket Cloud, GitLab.com or Azure Repos), and, at your request, exports those events as CSV or to your own Google BigQuery table or Amazon S3 bucket. You must supply an access token for your own repository and, optionally, credentials for the export destination, and you are responsible for their scope, security and revocation.
We grant you a non-exclusive, non-transferable, revocable right to use the App on the Jira site(s) covered by your Marketplace subscription. You may not reverse engineer or decompile the App (except where mandatory law allows), sublicense or resell it, or distribute derivative products based on it without permission.
The App and all its components (code, documentation, branding) remain the Provider's exclusive property. These Terms grant only the right of use described in section 3.
Fees are as published on the App's Atlassian Marketplace listing and are collected by Atlassian. We may change pricing through the Marketplace with prior notice; already-paid periods are not affected.
Personal data processed by the App is governed by the Privacy Policy, which forms part of these Terms.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that the calculated metrics are always accurate: they depend on revert-commit detection and on data returned by your Git provider.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE FEES YOU ACTUALLY PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM AROSE. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, LOST PROFITS OR LOSS OF DATA. This limitation does not apply to liability that cannot be limited or excluded under mandatory law, such as intentional misconduct.
You will indemnify us against third-party claims arising from your unlawful data input, use of the App in breach of these Terms, or your mishandling of your own access tokens and credentials.
These Terms apply from installation until the App is uninstalled or your Marketplace subscription ends. We may withdraw the App from the Marketplace and will, where practical, notify you beforehand through the Marketplace. On termination, stored data is handled as described in the Privacy Policy.
The App is run by an independent developer. We provide best-effort support without a formal SLA at support@cfrdashboard.app.
These Terms are governed by the laws of Hungary, without regard to conflict-of-law rules. Unless the parties agree otherwise, the Hungarian courts have exclusive jurisdiction, without prejudice to mandatory consumer or other rules that provide otherwise.
We may amend these Terms. We will give reasonable advance notice of material changes through the Marketplace listing or within the App; continued use after they take effect means you accept them.
